   • Each individual user is eligible for only one free trial. Creating multiple accounts or using different payment methods to obtain additional free trials is strictly prohibited and may result in the suspension or termination of your account, including for paying users.
   • Free trial terms, including duration and eligibility, are subject to change and will be specified at the time of the offer.
     
2. Subscription Plans
   • By subscribing to our Services, you agree to pay all fees associated with your chosen subscription plan.
   • Subscription plans are billed on a recurring basis (e.g., monthly or annually) as specified during registration.

     We reserve the right to suspend or terminate your subscription or account at any time, with or without notice, at our sole discretion, including but not limited to the following circumstances:

     • Abuse of the free trial or subscription system (e.g., creating multiple accounts).
     • Activities that negatively impact the platform, its community, or other users.
     • Any other reason deemed necessary to protect the integrity or functionality of the platform.
   • No Refund Policy:
     In the event of termination, you will not be entitled to a refund for any unused portion of your subscription
     
7. Promotions and Discounts
   • Any promotions or discounts offered are subject to the terms outlined at the time of the offer.

   • Users are encouraged to utilize the 7-day free trial (if offered) to evaluate the platform before subscribing.
   • No refunds will be issued for subscriptions that begin after the expiration of the free trial.

   • Cancellation will take effect at the end of the current billing period.
   • Access to the platform will continue until the billing period ends, and no refunds will be issued for the remaining period.
     
4. Exceptions
   • Refunds may be issued only in the following exceptional circumstances:
     • Duplicate payments caused by technical errors.
     • Billing errors attributable to us that result in overcharges.

11. Governing Law and Dispute Resolution

   • Arbitration: If the dispute cannot be resolved through negotiation within 30 days, it shall be referred to and finally resolved by arbitration under the rules of the Dubai International Arbitration Centre (DIAC), which are deemed to be incorporated by reference into this clause.
     • The seat of arbitration shall be Dubai, United Arab Emirates.
     • The arbitration proceedings shall be conducted in English.
     • The number of arbitrators shall be one.
     • Each party shall bear its own costs associated with the arbitration, unless otherwise determined by the arbitrator.

   • You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, collective, or representative action.
   • You expressly waive any right to participate in a class action or representative lawsuit.

   • We reserve the right to modify, suspend, or terminate promotions or discounts at any time without prior notice.
     
4. Misuse of Promotions
   • Any abuse of promotional offers, such as creating multiple accounts to claim the same promotion, may result in the suspension or termination of your account.

21. Account Inactivity

1. Inactive Accounts
   • If your account remains inactive for more than 12 months, we reserve the right to:
     • Deactivate the account and delete associated data.
     • Notify you via email at least 30 days before deactivation.
       
2. Reactivation
   • If your account is deactivated due to inactivity, you may contact us at support@bitcoinsensus.com to request reactivation. Reactivation will be subject to our review and discretion

While we strive to avoid disruptions, we cannot guarantee that there will not be an outage or change to the services, and your content may not be retrievable due to such outages or changes. We are not liable for any such outages or service changes.

• Legends Pro ($97 per month/ $261 three months / $990 one year)
  • Expert Analysis: Receive two pieces of daily chart analysis from Monday to Friday, provided by our experts Andy and Dewald.
  • Enhanced Learning: Access educational content suitable for all trading skill levels, from beginners to advanced traders.
  • Masterclass Access: Gain entry to both basic and advanced sections of Andy’s Masterclass.
  • Exclusive Content: Enjoy weekly live streams featuring short-term trading opportunities.
  • More Opportunities: Participate in bi-monthly contests and giveaways, and connect with a global trading community.

Payment Terms

To access these premium features, you need to fill out the form and make the required payment on the Legends Community website. Access to features and paid membership will be synced with your Discord username, so ensure you provide an existing and correct one.

• We currently do not accept credit card payments from GCC countries.
• If payment is not received within the specified timeframe, your access to paid areas will be revoked until payment is successfully processed.
• Refunds for membership fees are not provided, except in cases where required by applicable law.

FREE TRIAL

1. First time joiners who have never signed up to Bitcoinsensus before are entitled to a free trial.
2. We reserve the right to cancel a free trial if we suspect a user has registered in the past with different details.
3. The trial lasts 7 days and during this period the user will gain access to all features normally accessible to a Pro member. 
4. They will need to connect their Discord account with the right username to receive the Pro role in our server.
5. To access the free trial the user must:
   1. Register to our community via https://community.bitcoinsensus.com/en
   2. Provide their card details in the checkout 
6. The user will not be charged upon the start of the free trial. 
7. The user will be charged on the day that their free trial has come to an end and will be automatically deducted from the account linked to the card details provided.
8. The amount deducted is dependent on the pricing plan chosen when checking out.
9. The user can cancel their Pro subscription any time before the end of their trial period and they will not get charged any fees. 
10. After 168 hours from starting the trial period bitcoinsensus will charge the users card added upon checkout with a monthly fee for the Pro plan. 
11. If the user wants to avoid getting charged it is the user’s obligation to cancel before their free trial ends.
12. In case the charge gets rejected bitcoinsensus will wait X hours and try to charge again. If not successful the user will be  downgraded to the basic account (free plan).

Your Legends Community Account

You will need to have a Discord account to use the services and features of the Legends Trading Community on Discord. If you do not already have one, you can create it on the Discord platform by providing the necessary information as required by Discord’s terms of service. Bitcoinsensus also uses filters to prevent defamatory words being used and will not be held responsible for users not being able to access the server with user names that insight defamation, harm, hate speech or violence. 

Account Security

You are responsible for maintaining the confidentiality of your Legends Trading Community account and Discord account credentials and for all activities that occur under your accounts. We strongly recommend using a unique and strong password, not sharing it anywhere or with anybody, and enabling two-factor authentication to enhance security. If you suspect that your accounts have been compromised, please notify Legends Trading Community support (support@bitcoinsensus.com) or /Discord support immediately. Accurate Information It is essential to provide accurate and up-to-date information when creating your Discord account and to maintain the accuracy of this information. We rely on the information associated with your Discord account to communicate with you and to process any transactions you make within the Legends Community.

Account Management

If you lose access to your Discord account, you will need to follow Discord’s procedures to recover your account. If your account is compromised or you no longer have access to your email account or phone number associated with your Discord account, we may not be able to restore your access to the Legends Community or the services you have subscribed to.

Content

• Your Content: When we refer to “your content” in these terms, we mean all the materials you add (upload, post, share, etc.) to our services. This includes text, links, images, videos, documents, and other media.
  • You are not obligated to add content to the services. However, if you choose to do so, you are responsible for ensuring that you have the right to share it and that your content complies with all applicable laws. We do not take responsibility for your content and are not liable for how others use it.
  • Your content remains yours, but by using our services, you grant us a license to use it. This license allows us to:
    • – Use, copy, store, distribute, and display your content: For example, to store and show your content within the community or for ads purposes..
    • – Publish, publicly perform, or display your content: If you choose to make it visible to others, such as posting in public channels.
    • – Monitor, modify, translate, and reformat your content: For example, resizing an image to fit different devices.
  • This license is worldwide, non-exclusive (meaning you can still license your content to others), royalty-free (no fees for this license), transferable, and perpetual.
  • We reserve the right to block, remove, and/or permanently delete your content if it violates these terms, the Legends Trading Community User Agreement, or any applicable laws, or if it negatively impacts the community.
  • We welcome feedback on our services. By providing feedback, you grant us a non-exclusive, perpetual, irrevocable, transferable license to use the feedback and ideas without any restrictions, attribution, or compensation to you.
• Other Content: Our services may also provide access to content created by other users. You may not use this content without the creator’s consent or as allowed by law. Other users’ content is their own and does not necessarily reflect the views of the Legends Community. We do not endorse or verify the accuracy or reliability of content shared by users.
  • While we strive to maintain a safe and positive environment, we cannot always prevent you from encountering content that you may find objectionable or offensive. We are not liable for any harm caused by such content. You may report content that you believe violates our policies, and we have the right, but not the obligation, to review and remove such content at our discretion.

Restrictions on Your Use of Legends Community Services

By using our services, you must comply with the terms of the Legends Trading Community User Agreement, as well as the DISCORD TERMS OF SERVICE and all applicable laws and regulations in your jurisdiction. Do not do, try to do, or encourage or help others to do any of the following:

• Harmful Behavior: Do not attempt to gain unauthorized access to another user’s account, infringe on intellectual property rights, exploit, harass, bully, spam, or auto-message people through Discord platform and Legends Trading Community services.
• Illegal Activities: Do not use the services to plan or commit any crime or engage in any other illegal activities.
• Service Misuse: Discussions should remain focused on web3, cryptocurrency, and other relevant subjects that align with the server’s purpose.
• Violation: Copyright Only share content that you have created yourself or have obtained explicit permission from the creator to share. If a moderator removes content for violating intellectual property rights, do not repost it.

We encourage you to report any content or conduct that you believe violates these restrictions. Our goal is to maintain a safe, positive, and productive community environment for all members.

Termination

• Your Right to Terminate: You are free to stop using the Legends Trading Community services at any time and for any reason. For this, you will need to log into your user dashboard on the Legends Community Website, where you can find the option to terminate the subscription.
  • Please note that we do not provide any refund, but you still have premium access until the end of the period you have paid for. You can resume your subscription at any moment.
  • If you face any technical issues during this process, you can create a ticket via the Legends Community help channel on Discord.
  • The points described in the Legends Trading Community User Agreement, namely Restrictions on Your Use of Legends Community Services, will remain in effect even after the termination of your membership.
• Our Right to Terminate: We have the right to terminate a user at any time at our sole discretion, the most common (but not the only) reasons for which may include the following:
  • You breach these terms or any other policies or additional terms that apply to specific products.
  • We are required to do so to comply with a legal requirement or court order.
  • We reasonably believe termination is necessary to prevent harm to you, us, other users, or third parties.
  • Continuing to allow your membership to be active, giving you access to services, or hosting your content creates risk for the Legends Trading Community, other users, or third parties.

Appeals

We value transparency and work hard to give you context for the decisions we make. If you believe a moderator’s action was unjustified, you may appeal the decision by contacting a server administrator. However, the administrator’s decision will be considered final.

Limitation of Liability

Since the Legends Trading Community primarily operates on the Discord platform, the Legends Trading Community User Agreement adheres to the same legal provisions and restrictions.

Nevertheless, assuming the relevant details in the DISCORD TERMS OF SERVICE, we additionally reiterate the main provisions, which are that the information presented on or through the Legends Trading Community services is made available solely for informational purposes. We do not confirm the accuracy, completeness, or usefulness of the information. Any reliance you place on such information is solely at your own risk.

We work hard to offer great services, but there are certain aspects that we can’t guarantee. To the fullest extent permitted by law, Bitcoinsensus, its affiliates, and their respective suppliers make no warranties, either expressed or implied, about the services. The services are provided ‘as is’.

We also disclaim any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement, and any warranties arising out of the course of dealing or usage of trade. The laws of certain jurisdictions or states do not allow limitations on implied warranties. To the extent such warranties cannot be disclaimed under the laws of your jurisdiction, we limit the duration and remedies of such warranties to the full extent permissible under those laws.

Jurisdiction and Governing Law

This agreement is governed by the laws of Dubai, United Arab Emirates, without regard to its conflict of laws principles. Any legal action or proceeding related to this agreement must be brought in a court of competent jurisdiction in Dubai, United Arab Emirates.
